Former Baltimore City State’s Attorney Marilyn Mosby is battling to retain ownership of her Florida condominium as she appeals her mortgage fraud conviction.
Her lawyers argue that the property is her only “significant asset.”
Federal prosecutors are pushing to seize the condo on Florida’s Gulf Coast, according to a May 23 order by Judge Lydia Griggs.
They contend that Mosby should forfeit the property following her February 2024 mortgage fraud conviction, as reported by Fox 45 News.
Mosby purchased the Long Boat Key condo for $476,000 in February 2021. If sold at a profit, she would recover her $47,600 down payment, according to court documents.
Though Mosby has been granted a stay out of prison during her appeal, she is also seeking a presidential pardon.
Her legal team states that the condo was bought to secure financial independence amid her troubled marriage.
“While Ms. Mosby awaits the outcome of her appeal, the home has served as a critical source of rental income; it could soon become her sole source of income now that her legal career is in jeopardy,” court documents reveal.
They explained that the condo is Mosby’s only significant asset.
The defense notes that the condo’s value has appreciated since Mosby’s purchase. Redfin estimates it at $886,084, while Zillow values it at $781,800, according to the news station.
Mosby was convicted on one count of mortgage fraud in February after admitting she unintentionally made false statements on loan applications to buy two Florida vacation homes.
Additionally, in November, she was convicted of two counts of perjury for falsely claiming financial hardship during the COVID-19 pandemic to withdraw money from the city’s retirement fund.
She has yet to be sentenced in either case.
