The woman who sued Takeoff for rape two years before his death reportedly wants his mother to be the defendant for the lawsuit to continue.
Migos member TakeOff‘s legal problems might not be over because he’s no longer alive.
According to reports, the unknown woman who brought the lawsuit against the late Migos rapper for sexual assault in August 2020 wants to continue, even though the rapper died in November 2022.
On Dec. 8, news outlet, MyNewsLA, reported that the plaintiff who is suing Takeoff for an alleged rape in 2020 rape has filed new court documents requesting the case continue.
The woman, who chooses to remain anonymous, is reportedly requesting Takeoff’s mother, Titiana Davenport, to step into the defendant’s role in the case.
The plaintiff argued that Ms. Davenport is the best replacement since she is the acting administrator of Takeoff’s estate. As administrator of his estate, she manages the money he could have potentially owed himself if the court doesn’t rule in his favor.
The original lawsuit was filed in Los Angeles Superior Court in August of 2020, accusing the late rapper of sexually assaulting a woman during a party in an Encino home on June 23, 2020.
According to the legal documents, the accuser said Takeoff made her feel uncomfortable, and even though she rejected him during several attempts, he followed her into a bedroom and raped her.
She also disclosed that she received treatment at a local hospital, where doctors uncovered evidence of sexual trauma and alerted the police.
Now, after months of legal dormancy, the woman is making her next move and wants Takeoff’s mother, Titiana Davenport to be the defendant in the case.
A hearing was scheduled for February of next year to determine whether or not Davenport will be made the new defendant in the case.
A judge will reportedly decide on the motion during the next hearing for the case on February 22, 2024.
TakeOff, real name Kirshnick Ball, was shot and killed by a bullet to the head and neck when a gunman opened fire outside the bowling alley he was at on November 1, 2022.
