The divorce proceedings between RHOA Kandi Burruss and her estranged husband, Todd Tucker, are escalating rapidly. Initially hopeful for an amicable separation, the couple’s latest court filings indicate a shift towards a contentious legal battle.
Todd is making two significant and startling demands: he is seeking primary custody of their two children, Ace and Blaze, and is formally disputing the legitimacy of their widely publicized prenuptial agreement.
Court documents reveal that Todd is requesting primary physical custody, arguing that Kandi’s busy work schedule often keeps her away from home for long stretches. He contends that their children have primarily been living with him in Georgia, and he has taken on most of the daily parenting responsibilities while Kandi is frequently away on business.
“Kandi’s schedule will continue to require her to be away from the children for at least the next several months,” Tucker has asserted, emphasizing that if negotiations fail, he plans to pursue primary physical custody along with joint legal custody and final decision-making authority. While he acknowledges Kandi as a devoted mother, his position focuses on who has been more present in their children’s lives.
In addition to the custody dispute, Todd is also challenging the financial aspects of their marriage by questioning the terms of their 2014 prenuptial agreement. Signed right before their wedding, the agreement was highly publicized. Todd now claims he felt pressured to sign it without proper legal representation. He alleges that although discussions occurred between Kandi’s lawyers and his team, the final version of the prenup was unexpectedly presented to him at the last moment, leaving no opportunity for thorough review.
Todd is suggesting that this pressure, combined with the absence of his legal counsel during the signing process, may render the prenup unenforceable. Should the court agree with him, it could allow him to seek alimony and a significant share of Kandi’s substantial assets, including her stake in the Old Lady Gang restaurant chain and her music catalog.
Meanwhile, Kandi is pushing for the court to uphold the prenuptial agreement as it stands and is also requesting joint custody of their children. As Todd aims for a peaceful resolution, his pursuit of primary custody and the challenge to the prenup are shaping this divorce into one of Atlanta’s most complicated legal dramas.
