Rep. LaMonica McIver (D-N.J.) faces a new federal indictment tied to a May confrontation outside a Newark immigration detention facility, escalating a legal battle she claims is politically motivated.

The U.S. Attorney’s Office for the District of New Jersey announced the charges Tuesday, accusing McIver of forcibly obstructing law enforcement officers during an attempted arrest at Delaney Hall Federal Immigration Facility. Acting U.S. Attorney Alina Habba defended the indictment on X, stating her duty to protect federal officers executing their duties.

The incident followed a congressional oversight visit by McIver, Reps. Bonnie Watson Coleman (D-N.J.), and Robert Menendez Jr. (D-N.J.). The lawmakers described the tour as routine, but tensions flared when protesters clashed with ICE agents.

Newark Mayor Ras Baraka (D) was briefly detained for trespassing—charges later dropped—and alleged his arrest was “targeted.”

McIver, initially charged last month, denies wrongdoing, calling the indictment an attempt to “criminalize legislative oversight.”

On June 10, she accused the Trump administration of using the charges to evade accountability for ICE’s actions and intimidate her.

The case has reignited debates over immigration enforcement and political retaliation, with progressives rallying behind McIver. Legal experts suggest the indictment could test protections for lawmakers conducting oversight.
