She claims Diplo, born Thomas Wesley Pentz, took advantage of her over some time beginning from when she was 17 years old.
Shelly Auguste, an ex-girlfriend of Diplo, said the executive DJ sent nude photos of her to another person without her consent as revenge.
25-year-old Shelly Auguste, who reportedly dated Diplo in 2020, accused the DJ of recording sexually explicit videos of her without her permission.
Since they split in 2020, the pair have been in a legal battle, and this is the second time she has accused him of distributing revenge porn.
This time around, Shelly Auguste has added sexual battery, gender violence, battery, assault, defamation, fraud, intentional intrusion into private affairs, and intentional infliction of emotional distress to her suit.
She also included a violation of the Ralph Civil Rights Act and a Tom Bane Civil Rights Act violation. A civil trial has been scheduled in April 2024 for these hearings.
Shelly Auguste said in her legal documents that Diplo first contacted her on Twitter in 2014 when she was 17. She revealed that they formed a correspondence online, which led to her sending him nude photos.
She disclosed that they finally had sexual intercourse in April 2019, when she turned 22 years old.
In her complaint, Shelly Auguste alleged that Diplo recorded their intimate act on his cell phone and ejaculated inside of her. She claims he didn’t seek her consent in either act.
In October 2021, Diplo publicly denied her initial claims, which she filed in June of that year.
Currently, he is also counter-suing her for stalking, trespassing, and distributing private materials.
According to Diplo, Auguste became “dangerously unstable” and has “made relentless efforts to communicate with him” after he ended their relationship. He also included these instances in the lawsuit he filed in April 2021.
Diplo’s attorney, Bryan J. Freedman, spoke with some media outlets. He said:
“For more than three years, Shelly Auguste has been orchestrating an ongoing smear campaign against Wes—and this is just more of the same.”
, “Now, Ms. Auguste is at it yet again. But Wes will defend himself, and, just as he has done every time Ms. Auguste has defamed, harassed, and attacked him and his family, he will win,” Freedman disclosed to Pitchfork.
