4-Year-Old’s Tragic Death in Pool of ‘Family-Friendly’ Miami AirBnB Sparks Legal Fight

The tragic drowning of 4-year-old Kennedi Ray at a vacation rental in South Florida is now at the center of a growing legal battle, as her family demands accountability from both the homeowner and Airbnb over what they say were missing safety features required by law.

Kennedi, who had autism, died on March 5 after wandering out of the rental property and falling into a backyard pool while her parents slept during a family trip to Miami.

A Family’s Loss and Call for Accountability

Kennedi’s parents, visiting from Atlanta, say the home had been advertised as “family-friendly,” but lacked critical safety measures designed to prevent child drownings.

“I lost my child,” her mother, Adenah Francis, said during an emotional press conference. “She only got four years here. We loved her so much.”

According to the family, Kennedi quietly left the house during the early morning hours and accessed the pool area, where she drowned. She was later found at the bottom of the pool.

Alleged Violations of Florida Safety Law

Under Florida Residential Swimming Pool Safety Act, residential pools must have protective barriers such as fencing or alarms on doors leading to pool areas.

The family’s attorney, Adam Finkel, argued that the property failed to meet these requirements.

“How can a house be advertised as family-friendly when it has a pool and none of the safety measures necessary in place?” Finkel said. “No barriers, no fence, doors without alarms.”

The family maintains that these safeguards exist specifically to prevent tragedies like Kennedi’s.

Lawsuit Planned Against Homeowner and Airbnb

Kennedi’s parents say they plan to file a lawsuit against both the property owner and Airbnb, alleging negligence and misleading advertising.

The property has since been removed from Airbnb, but the family says it remains listed on other rental platforms. They are calling for it to be taken down entirely.

“I just want them to fix it or put it down so that nobody ever has to go through this,” Francis said.

Airbnb Responds

In a statement, Airbnb expressed condolences to the family and said it has supported efforts to strengthen pool safety regulations.

The company also pointed to ongoing initiatives, including educational campaigns and programs offering discounted pool safety equipment for hosts.

Broader Safety Concerns

The case has renewed scrutiny over short-term rental safety standards, particularly for properties marketed toward families. Advocates say stricter enforcement and clearer accountability may be needed to ensure compliance with existing laws.

For Kennedi Ray’s family, however, the focus remains on preventing another tragedy.
